1. Who can use Fanyello
You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian has agreed to these terms for you. You may not use Fanyello if we have previously removed you, or if the law where you live does not allow it. Give accurate information when you sign up, keep one account for yourself, and keep your password and recovery code private. You are responsible for what happens on your account.
2. Community rules: zero tolerance
Fanyello is for friends, family and people who treat each other well. You may not post, send, stream or share anything that:
- sexually exploits or endangers children in any way, including any sexual content involving anyone under 18;
- is pornographic or sexually explicit, or solicits sexual images or contact;
- harasses, bullies, threatens, stalks, doxxes, or intimidates anyone;
- attacks people because of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or serious illness (hate speech);
- promotes or glorifies violence, terrorism, self-harm or suicide, or encourages anyone to hurt themselves;
- sells or promotes illegal drugs, weapons, or other illegal goods or services;
- is spam, a scam, a phishing attempt, malware, or misleading in a way that could cause harm;
- impersonates someone else or misrepresents who you are;
- shares someone’s private information or intimate images without their consent;
- infringes someone else’s copyright, trademark, privacy or other rights.
You also may not misuse the service: no scraping, automated accounts, attempts to break into accounts or systems, interfering with Fanyello, or getting around a block, suspension or safety feature.
Breaking these rules can get your content removed and your account suspended or permanently banned without warning. When content may involve a child’s safety or a threat to someone’s life, we report it to the National Center for Missing & Exploited Children (NCMEC) or law enforcement as the law requires.
3. Reporting, blocking and how we respond
You can report a post, comment, video, message, live stream or profile from its menu in the app, and you can block anyone. Blocking hides that person’s content from you and stops them from contacting you. Fanyello automatically screens text for some kinds of harmful content before it is posted. We review reports and act on them, usually within 24 hours, by removing content and suspending or banning the people responsible. You can also reach us at support@fanyello.com or through Help & Support in the app.
4. Your content
You own the photos, videos, messages, posts and other content you share. You give Fanyello a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and send your content as needed to run, improve, secure and moderate the service, and to show it to the people you choose. This license ends when you delete the content or your account, except for copies kept for legal reasons, safety investigations, or in backups for a limited time. You confirm that you have the rights to everything you share and that it follows these terms. Choose your audience carefully: content you make public or post to Discover can be seen by anyone on Fanyello.
5. Disappearing photos, screenshots and location
View-once photos and screenshot receipts reduce ordinary copying but cannot stop another device, camera, or modified software from saving something. Location sharing is off until you turn it on, and you choose who sees it and for how long. Share only what you are comfortable with the people you share it with seeing.
6. Copyright
If you believe content on Fanyello infringes your copyright, send a notice to support@fanyello.com with your contact information, the work, where the content is on Fanyello, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature. We remove infringing content and close the accounts of repeat infringers.
7. Fanyello’s rights
Fanyello, its name, logo, avatars, artwork and software belong to Fanyello LLC. We give you a personal, non-transferable, revocable license to use the app for its intended purpose under these terms. Features may change, be added, or be removed. We may remove content or limit, suspend or end any account that breaks these terms or puts people or the service at risk. You can delete your account at any time in Settings.
8. Purchases
If Fanyello offers paid features, purchases in the iPhone app are made through Apple and follow Apple’s terms. Prices and what is included are shown before you buy. Except where the law or Apple’s refund policy requires otherwise, purchases are final.
9. Disclaimers
Fanyello is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted, secure, or error-free, or that content will never be lost. We are not responsible for what other people post, send or do, on or off Fanyello.
10. Limitation of liability
To the fullest extent the law allows, Fanyello LLC and its members, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Fanyello. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
11. Indemnity
If someone brings a claim against us because of content you shared or your breach of these terms, you agree to cover the reasonable costs, to the extent the law allows.
12. Governing law
These terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in New York, and you and Fanyello consent to their jurisdiction, except where the law where you live gives you the right to bring a claim locally.
13. Apple App Store
If you downloaded Fanyello from Apple’s App Store: these terms are between you and Fanyello LLC, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any product claims, legal-compliance claims, or intellectual-property claims about the app; Fanyello is. If the app fails to meet a warranty that applies by law, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. You confirm that you are not in a country under a U.S. government embargo or listed on a U.S. prohibited-parties list. You must also follow any third-party terms that apply when you use the app (for example, your mobile carrier’s). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes and contact
We may update these terms. When we make significant changes, we will tell you in the app before they take effect, and you will be asked to agree again. If you do not agree, stop using Fanyello and delete your account. Questions: support@fanyello.com · Fanyello LLC, New York, USA.
